Agreement to Terms

By accessing or using this website, you agree to be bound by these Terms of Service. If you don't agree, please don't use this site. DAC Live Trading ("we," "us," "our") may update these terms from time to time; continued use of the site after a change means you accept the updated terms.

What This Site Is

This website is informational and promotional — it describes our wholesale/liquidation business and links to where we actually sell (eBay Live and Whatnot). We do not process orders, payments, or checkouts directly through this site. All purchases happen on the third-party marketplace where the listing appears, and are governed by that marketplace's own terms, policies, and buyer protections in addition to these terms.

Products Sold Through Our Marketplace Listings

• We sell wholesale, liquidation, closeout, and surplus merchandise. Unless a specific listing states otherwise, items are sold as-is, with no guarantee of original packaging, completeness, or manufacturer warranty.
• Condition, quantity, and contents of any "mystery," "mixed lot," or box-style listing are approximate and revealed at the time of sale — we make reasonable efforts at accurate descriptions but do not guarantee an exact match to any sample shown.
• Returns, refunds, and disputes for a specific order are handled through the marketplace the order was placed on (eBay or Whatnot), under that marketplace's buyer protection policies.

Acceptable Use

You agree not to: use this site for any unlawful purpose; attempt to gain unauthorized access to any part of the site, including the staff dashboard; scrape, crawl, or harvest data from the site in an automated way without our permission; or interfere with the site's normal operation.

Intellectual Property

The DAC Live Trading name, logo, and site content are our property (or used with permission) and may not be copied, reproduced, or used without our written consent, except for normal personal browsing of the site.

Third-Party Links and Marketplaces

Links to eBay, Whatnot, or any other third-party site are provided for convenience. We don't control those platforms and aren't responsible for their content, availability, or policies. Your use of any third-party marketplace is governed by that marketplace's own terms.

Disclaimer of Warranties

This site is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee the site will be uninterrupted, error-free, or secure.

Limitation of Liability

To the fullest extent permitted by law, DAC Live Trading is not liable for any indirect, incidental, special, or consequential damages arising from your use of this site or reliance on its content. Our total liability for any claim arising from this site is limited to the amount (if any) you paid us directly in connection with that claim — orders placed on eBay or Whatnot are subject to those marketplaces' own liability and buyer-protection terms instead.

Indemnification

You agree to indemnify and hold DAC Live Trading harmless from any claim or demand, including reasonable attorneys' fees, arising out of your misuse of this site or violation of these terms.

Dispute Resolution

If a dispute arises out of these terms or this site, we ask that you first contact us directly so we can try to resolve it informally. If it can't be resolved informally, both parties agree to attempt resolution through binding arbitration on an individual basis (not as part of a class action) before resorting to court, to the extent permitted by applicable law.

Governing Law

These terms are governed by the laws of the United States and the state in which DAC Live Trading is organized, without regard to conflict-of-law principles.

Severability

If any part of these terms is found unenforceable, the rest remains in full effect.
